People v. Nocido

G.R. No. 240229 · 2020-06-17 · J. PERALTA, J.: · Primary: Criminal; Secondary: Children's Rights
REITERATION

Facts

1. The Antecedents: The case involves an appeal by Niel Raymond A. Nocido from the Court of Appeals' decision affirming his conviction for Rape through Sexual Intercourse and Rape by Sexual Assault. The charges stem from an incident on August 3, 2009, in Makati City, where Nocido, along with co-accused Paul Justin Ventura and Marianito Bagon, allegedly attacked and sexually assaulted a 12-year-old complainant, AAA, using force, violence, and intimidation. The Amended Informations detail the carnal knowledge of the victim and the insertion of fingers and penis into her orifices. 2. Procedural History: Nocido pleaded not guilty to both charges. The trial proceeded in the absence of his co-accused. The prosecution presented three witnesses, including the victim, AAA, who recounted the ordeal. The defense presented Nocido's denial and shifted blame to his co-accused. The Regional Trial Court (RTC) of Makati City, Branch 136, found Nocido guilty beyond reasonable doubt in a Partial Decision dated August 5, 2015, sentencing him to reclusion perpetua for rape through sexual intercourse and an indeterminate penalty for rape by sexual assault, along with civil and moral damages. Nocido appealed to the Court of Appeals (CA), which affirmed the RTC's decision with modifications to the penalties and damages in its April 25, 2017 Decision. 3. The Petition: Nocido filed a petition for review with the Supreme Court, faulting the CA for affirming his conviction based on what he claims is AAA's inconsistent and incredible testimony. He argues that the Medico-Legal Report does not support a finding of penetration and that his mere presence at the scene does not establish conspiracy. The Supreme Court, however, found the appeal without merit, affirming Nocido's guilt but modifying the conviction for the second charge to Lascivious Conduct under Section 5(b) of Republic Act No. 7610, and adjusting the penalties and damages accordingly, while also noting that ignominy could not be appreciated as an aggravating circumstance because it was not alleged in the Information.

Issue(s)

Whether the CA erred in giving due weight and credence to AAA's testimony. Whether the CA erred in convicting Nocido guilty beyond reasonable doubt of the crimes of rape through sexual intercourse and rape by sexual assault; and whether Nocido is guilty as a conspirator. On the classification of offenses and penalties; and on damages.

Ruling

The appeal is dismissed. The Supreme Court affirmed the conviction of Niel Raymond A. Nocido with modifications to the awards of damages and the classification of offenses. Nocido was found guilty of Rape under Article 266-A(1)(a) of the Revised Penal Code in Criminal Case No. 09-1772 and Lascivious Conduct under Section 5(b) of Republic Act No. 7610 in Criminal Case No. 09-1773.

Ratio Decidendi

On the weight and credence of AAA's testimony: The Court held that AAA's testimony, despite minor inconsistencies regarding who held her arms, was credible and sufficient for conviction. The Court noted that minor inconsistencies can even enhance credibility by showing spontaneity. The Court also addressed the argument that AAA did not scream or resist, stating that such failure does not negate consent, especially when force, threat, and intimidation were employed, as evidenced by AAA's testimony of being threatened with a knife and being beaten when she struggled. The Court emphasized that the victim's testimony, if clear, positive, and probable, is sufficient to prove rape, even without corroboration. On the conviction for rape through sexual intercourse and rape by sexual assault; and on Nocido's guilt as a conspirator: The Court affirmed the conviction, finding that all elements of the crimes were proven beyond reasonable doubt. The Court clarified that hymenal laceration is not a necessary element of rape, as the slightest penetration is sufficient. The Court also noted that the medico-legal report is not indispensable and that the victim's testimony is paramount. The Court found that conspiracy was established, demonstrating a common design to commit the unlawful purpose. The Court detailed the concerted actions of Nocido, Bagon, and Ventura, including Bagon poking AAA with a knife, Nocido and Bagon dragging her, all three beating her, Nocido and Bagon removing her clothes while Ventura provided light, and their simultaneous abuse of AAA. The Court concluded that Nocido was guilty as a co-conspirator in the rape through sexual intercourse and personally committed lascivious conduct. On the classification of offenses and penalties; and on damages: The Court found it proper to convict Nocido for Lascivious Conduct under Section 5(b) of R.A. 7610, even though the Information charged Rape by Sexual Assault. This was based on the victim's age and the nature of the acts committed. The Court applied the penalties prescribed by R.A. 7610, which provides a higher penalty for offenses against children, aligning with the State's policy of protecting children. The Court also clarified the application of the Indeterminate Sentence Law and the penalties for rape committed by two or more persons. The Court affirmed the award of civil indemnity, moral damages, and exemplary damages, citing jurisprudence that these are mandatory upon a finding of rape and lascivious conduct. The Court adjusted the amounts based on prevailing jurisprudence and ordered legal interest on all awarded damages from the finality of the judgment.
