Facts

The Antecedents: The case stemmed from an Amended Information charging accused-appellant R. Lorenz Esguerra y Baliber @ "RR" and his companions with Illegal Sale of Dangerous Drugs under Section 5, Article II of Republic Act No. (RA) 9165. The prosecution alleged that on March 18, 2010, PDEA operatives conducted a buy-bust operation at accused-appellant's residence, recovering one (1) plastic sachet containing white crystalline substance from his possession. The seized item tested positive for methamphetamine hydrochloride or shabu. Accused-appellant denied the charge, claiming he was asleep when PDEA operatives barged in, searched his residence, and arrested him without just cause. Procedural History: The Regional Trial Court (RTC) of Butuan City, Branch 4, found accused-appellant guilty beyond reasonable doubt and sentenced him to life imprisonment and a fine of P500,000.00. The RTC ruled that the prosecution established all elements of the crime and substantially complied with the chain of custody rule. The Court of Appeals (CA) affirmed the RTC Decision in toto, holding that the seized drug was properly marked, inventoried, and photographed in the presence of required witnesses and the accused. The Petition: Accused-appellant appealed to the Supreme Court, arguing for his acquittal due to the alleged failure to properly preserve the identity and integrity of the seized drug.

Ratio Decidendi

On the elements of Illegal Sale of Dangerous Drugs and compliance with the chain of custody rule: The Court reiterated that in every prosecution for Illegal Sale of Dangerous Drugs under Section 5, Article II of RA 9165, the prosecution must prove beyond reasonable doubt the identity of the buyer and seller, the object, and the consideration, as well as the delivery of the thing sold and the payment. The records clearly showed that accused-appellant was caught in flagrante delicto selling shabu to the poseur-buyer, IO1 Balbada, during a legitimate buy-bust operation. The Court found no reason to deviate from the factual findings of the courts a quo. On compliance with the chain of custody rule: Furthermore, the integrity and evidentiary value of the seized drug were deemed properly preserved because the PDEA team sufficiently complied with the chain of custody rule under Section 21, Article II of RA 9165. The marking, physical inventory, and photography of the seized items were conducted immediately after seizure and confiscation in the presence of the accused, an elected public official (Brgy. Captain Abucejo), media representatives (Licup and Brangan), and a DOJ representative (Bedrijo), which conformed to the witness requirements prior to the amendment of RA 9165 by RA 10640. The illegal drug was subsequently delivered to the crime laboratory for examination and presented in court, thus, the chain of custody remained unbroken and the integrity of the corpus delicti was properly preserved.
