REITERATION

Facts

The Antecedents: An administrative case was initiated against Eden P. Rosare (Rosare), Clerk of Court II of the Municipal Trial Court (MTC), Labo, Camarines Norte, for alleged violation of OCA Circulars, Gross Dishonesty, and Malversation of Public Funds or Property. Audits conducted from November 2014 to February 2017 revealed discrepancies in Rosare's cash on hand and unremitted collections. Initially, a shortage of P68,404.00 was discovered, which was partially reduced after Rosare located some of the funds. Further audits revealed more significant shortages, totaling P456,470.38, across various funds including Fiduciary Fund (FF), Sheriffs Trust Fund (STF), Judiciary Development Fund (JDF), Special Allowance for the Judiciary Fund (SAJF), Mediation Fund (MF), and General Fund (GF). Rosare also failed to deposit collections promptly, failed to refund cash bonds, misallocated marriage solemnization fees, and did not properly update cash books and official receipts. Procedural History: Rosare was required to explain the shortages and her failures. She was subsequently relieved from her position and her authority to handle court funds was suspended in February 2017. The Audit Team recommended her dismissal from service. The Office of the Court Administrator (OCA) approved these findings and recommendations, docketing the case as a formal administrative complaint and recommending dismissal, forfeiture of benefits, and filing of appropriate criminal charges. The Petition: The case was brought before the Supreme Court for resolution on whether Rosare should be held administratively liable for the acts complained of.

Issue(s)

Whether Rosare should be held administratively liable for dishonesty and gross neglect of duty due to failure to properly account for court funds and property.

Ruling

The Supreme Court found Eden P. Rosare guilty of dishonesty and gross neglect of duty and ordered her dismissal from the service. Her retirement benefits, except for accrued leave credits, were forfeited, and she was perpetually disqualified from re-employment in the government. She was also ordered to restitute the total amount of P456,470.38. The OCA was directed to file appropriate criminal charges against her.

Ratio Decidendi

On Whether Rosare should be held administratively liable for dishonesty and gross neglect of duty: The Court ruled in the affirmative, finding Rosare guilty of dishonesty and gross neglect of duty. The Court noted Rosare's failure to perform her responsibilities with utmost diligence, specifically her remissness in depositing court collections on time, updating cashbooks, and submitting monthly reports. Her explanations for the infractions were found unpersuasive. The Court emphasized that as a Clerk of Court, Rosare is an accountable officer responsible for court funds and property, and her failure to properly account for these funds constitutes dishonesty and gross neglect of duty, punishable by dismissal. The shortages incurred, totaling P456,470.38, and the delay in remittance of collections were in flagrant violation of various circulars and joint circulars, including COA-DOF Joint Circular No. 1-81, OCA Circular No. 50-95, and SC A.C. No. 3-2000. The Court reiterated that dishonesty is not mere negligence but involves intent, and the failure to remit funds upon demand without justifiable reason constitutes prima facie evidence of personal use. Rosare's actions fell short of the high ethical standards expected of court employees, thus warranting the penalty of dismissal.

Main Doctrine

A Clerk of Court found to have incurred significant shortages in court funds, failed to remit collections on time, and neglected to submit required financial reports is guilty of dishonesty and gross neglect of duty, warranting dismissal from service with forfeiture of benefits and perpetual disqualification from re-employment.
