Facts

The Antecedents: XXX was charged with three counts of qualified rape before the Regional Trial Court (RTC). The Informations alleged that XXX, by means of force and intimidation, had carnal knowledge of AAA255677, a minor, who is his stepdaughter. In Criminal Case No. MC15-4695-FC, the act was qualified by the victim's minority and relationship to the accused. In Criminal Case No. MC15-4696-FC, the qualification was also based on minority and relationship. In Criminal Case No. MC15-4661-FC, the qualification was based on the victim's minority and the accused being her step-father. XXX pleaded not guilty. The parties stipulated on AAA255677's minority. AAA255677 testified about the sexual assaults in each case, detailing the force, intimidation, and pain experienced. The physical examination of AAA255677 revealed a deep healed laceration. XXX denied the accusations, presenting alibis for each incident and claiming AAA255677 fabricated the stories. Procedural History: The RTC convicted XXX for qualified rape in Criminal Case No. MC15-4661-FC and for acts of lasciviousness in Criminal Case No. MC15-4695-FC. XXX was acquitted in Criminal Case No. MC15-4696-FC due to insufficiency of evidence. The Court of Appeals (CA) affirmed the RTC's findings with modifications as to penalties and damages. XXX appealed to the Supreme Court. The Petition: XXX reiterated his arguments that the prosecution failed to establish the charges and that AAA255677's testimony was incredible.

Ruling

XXX was found guilty of simple rape in Criminal Case No. MC15-4661-FC and lascivious conduct under Section 5(b) of R.A. No. 7610 in Criminal Case No. MC15-4695-FC. The Court modified the penalties and awards of damages.

Ratio Decidendi

On the qualifying circumstances of minority and relationship for qualified rape: The Court held that while the minority of AAA255677 was sufficiently proven, the qualifying circumstance of relationship (stepfather-stepdaughter) was not adequately established due to insufficient proof of legal relationship. Consequently, XXX could only be convicted of simple rape, not qualified rape, in Criminal Case No. MC15-4661-FC. On the conviction for lascivious conduct under R.A. No. 7610: The Court agreed that XXX committed lascivious conduct but found that the lower courts erred in classifying the offense as acts of lasciviousness under Article 336 of the Revised Penal Code. Applying the guidelines in People v. Ursua, the Court determined the offense should be designated as lascivious conduct under Section 5(b) of R.A. No. 7610, carrying a penalty of reclusion temporal in its medium period to reclusion perpetua. All elements of lascivious conduct under R.A. No. 7610 were proven. On the penalties and damages: The Court modified the penalties and damages awarded. For simple rape in Criminal Case No. MC15-4661-FC, XXX was sentenced to reclusion perpetua and awarded P75,000.00 civil indemnity, P75,000.00 moral damages, and P75,000.00 exemplary damages. For lascivious conduct in Criminal Case No. MC15-4695-FC, XXX was sentenced to an indeterminate penalty of eight (8) years and one (1) day of prision mayor, as minimum, to seventeen (17) years, four (4) months and one (1) day of reclusion temporal, as maximum, with a fine of P15,000.00. Civil indemnity, moral damages, and exemplary damages were set at P50,000.00 each. All awards were subject to legal interest.

Main Doctrine

Qualifying and aggravating circumstances must be sufficiently alleged in the Information and established during trial with proof beyond reasonable doubt. An accused cannot be held liable for the qualified nature of a crime based solely on admission or stipulation without independent proof, especially when the relationship is a qualifying circumstance in rape.
