People v. Partisala
REITERATIONFacts
The Antecedents: The case involves charges against municipal officials and a private individual for violation of Section 3(e) of Republic Act No. 3019 (Anti-Graft and Corrupt Practices Act) and Falsification of Public Documents under Article 171 of the Revised Penal Code. The charges stemmed from the alleged falsification of minutes of the Sangguniang Bayan (SB) of Maasin, Iloilo, to authorize Mayor Rene Mondejar to enter into a Memorandum of Agreement (MOA) with International Builders Corporation (IBC) for the rechanneling of the Tigum River. This MOA allegedly allowed IBC to engage in massive quarrying of sand and gravel without the necessary permits, causing damage to the government. Procedural History: Accused-appellant Arnaldo Partisala, the Municipal Vice Mayor, was initially at large. The Sandiganbayan convicted several co-accused, including Mayor Mondejar and IBC President Helen Edith Lee Tan. Partisala was later apprehended, and trial proceeded against him. The Sandiganbayan found Partisala guilty beyond reasonable doubt of violation of Section 3(e) of RA 3019 and Falsification of Public Documents. Partisala appealed this decision. The Petition: Partisala challenged his conviction, arguing that the prosecution failed to prove the falsification of the minutes and that he did not give unwarranted benefits to anyone. He contended that his presented Exhibit "8" was the authentic minutes, which showed the resolutions were validly enacted.
Issue(s)
Whether the act of the Sangguniang Bayan members, including Partisala, in authorizing Mayor Rene Mondejar to enter into the Memorandum of Agreement, gave unwarranted benefit and/or advantage to Helen Edith Lee Tan in violation of R.A. No. 3019. Whether accused Partisala, with his co-accused public officers, conspired with each other in falsifying the Minutes of the Regular Session of the Sangguniang Bayan of Maasin, Iloilo.
Ruling
The Supreme Court dismissed the appeal and affirmed the conviction of Arnaldo Partisala. The Court modified the penalty imposed for Falsification of Public Documents, sentencing him to imprisonment of two (2) years of prision correccional, as minimum, to eight (8) years and one (1) day of prision mayor, as maximum, and to pay a fine of P5,000.00. The penalty for violation of Section 3(e) of RA 3019 was affirmed.
Ratio Decidendi
On the issue of violation of Section 3(e) of RA 3019: The Court found Partisala guilty of violating Section 3(e) of RA 3019. It reiterated the elements of the offense: (1) offender is a public officer; (2) act done in discharge of official functions; (3) act done through manifest partiality, evident bad faith, or gross inexcusable negligence; and (4) undue injury or unwarranted benefits/advantage/preference. Partisala, as presiding officer, acted with manifest partiality and evident bad faith by signing and facilitating the approval of falsified minutes (Exhibit "8"). This paved the way for Mayor Mondejar to enter into the MOA with IBC, which was grossly disadvantageous to the government. IBC received unwarranted benefits by being allowed to extract sand and gravel without the necessary provincial permit, under the guise of the rechanneling project. The Court emphasized that the authority to extract quarry resources rests with the provincial governor, and the SB acted without authority in authorizing IBC through the MOA, causing undue injury to the government. Partisala's participation in the falsification was crucial for IBC to obtain this unwarranted benefit. On the issue of Falsification of Public Documents: The Court found that all elements of Falsification of Public Documents under Article 171 of the Revised Penal Code were sufficiently proven. Partisala, as Vice Mayor and presiding officer, took advantage of his official position. The prosecution presented testimonies of SB Members Trojillo and Albacete, who affirmed that the minutes presented by the defense (Exhibit "8") contained insertions, specifically items 9 to 12, which were not deliberated upon during the June 21, 1996 session. These insertions made it appear that Resolution Nos. 30-A and 30-B were validly enacted, authorizing the MOA for quarrying activities. Partisala's persuasion of Trojillo to sign the falsified minutes further demonstrated his participation in the scheme. The Court held that there was no need to present the alleged "true copy" of the minutes (Exhibit "B") as Partisala admitted his participation in executing Exhibit "8," and the testimonies of Trojillo and Albacete established that it contained matters not discussed. The Court also noted the illogical placement and subject matter of Resolution Nos. 30-A and 30-B in relation to other resolutions enacted on the same day, indicating they were inserted to legitimize the MOA.
Main Doctrine
The Court affirmed the conviction of Arnaldo Partisala for Falsification of Public Documents under Article 171 of the Revised Penal Code and violation of Section 3(e) of Republic Act No. 3019, holding that the prosecution sufficiently proved that Partisala, as Vice Mayor and presiding officer, participated in falsifying the minutes of the Sangguniang Bayan session to make it appear that resolutions authorizing a Memorandum of Agreement for massive quarrying were validly enacted, thereby giving unwarranted benefits and advantage to a private individual to the prejudice of the government.
