Ruling

The Supreme Court En Banc resolved the consolidated cases as follows: 1. In A.M. No. P-23-084 (OCA IPI No. 11-3696-P): a. Respondent Atty. Louie T. Guerrero was found GUILTY of five counts of gross misconduct (discourtesy towards Judge Gapas-Agbada, unauthorized recording of conversation, covertly taking photos/videos, threatening staff, participating in the 'sosyodad') and partisan political activity. He was FINED PHP 100,000.00 for each of the five counts of gross misconduct and PHP 100,000.00 for partisan political activity. In A.M. OCA IPI No. 12-4000-RTJ: a. The administrative complaint against Judge Genie G. Gapas-Agbada was DISMISSED for utter lack of merit. 3. In A.M. No. P-23-086 (OCA IPI No. 12-2548-MTJ): a. The administrative complaint against Judge Lorna B. Santiago-Ubalde was DISMISSED for utter lack of merit. b. The administrative complaint against Isidro Guerrero was DISMISSED due to his death. His survivorship benefits and earned leave credits were ordered released to his heirs. c. Aristotle Ramos was found GUILTY of serious dishonesty for falsification of daily time records and FINED PHP 50,000.00 with a STERN WARNING. Other charges against him were dismissed. d. The administrative complaint against Orlando Arcilla was DISMISSED as he was already issued a stern warning in a previous case for the same offense. Other charges were dismissed. 4. In A.M. No. P-23-085 (OCA IPI No. 12-3996-P): a. Karina Tabuzo was found GUILTY of serious dishonesty for falsification of daily time records and FINED PHP 50,000.00 with a STERN WARNING. Other charges were dismissed. b. The OCA was ORDERED to investigate allegations of Karina Tabuzo traveling abroad without clearance. 5. In A.M. OCA IPI No. 11-3764-RTJ: a. The administrative complaint against Judge Genie Gapas-Agbada was DISMISSED for utter lack of merit. b. The administrative complaint against Judge Lorna B. Santiago-Ubalde was DISMISSED for utter lack of merit.

Ratio Decidendi

On the charges against Atty. Louie T. Guerrero (A.M. No. P-23-084): The Court found Atty. Guerrero guilty of five counts of gross misconduct and partisan political activity. His discourtesy towards Judge Gapas-Agbada, involving insulting and demeaning language such as "liar," "cripple," and "traitor," violated Rules 1.01, 7.03, and 11.03 of the Code of Professional Responsibility (CPR). The Court imposed fines for each offense and ordered forfeiture of benefits, disqualification from Judiciary positions, and disbarment from the practice of law due to the flagrant and repeated violations of the CPR and his oath. On the counter-charges against Judge Genie G. Gapas-Agbada (A.M. OCA IPI No. 12-4000-RTJ): The Court dismissed all charges against Judge Gapas-Agbada for lack of substantial evidence. Atty. Guerrero's allegations of her drafting decisions, requiring staff to run errands, engaging in drinking sessions, smoking in chambers, fraternizing with Atty. Borja, and showing favoritism were not substantiated. The Court found the testimonies of Atty. Guerrero's witnesses to be unreliable, either due to bias (Karen, Reymond) or similarity in wording, and the photographic evidence inconclusive. The presumption of regularity in the performance of her official duties was not overcome. On the charges against Judge Lorna B. Santiago-Ubalde and other court personnel (A.M. No. P-23-086) regarding Judge Ubalde: The charges against Judge Ubalde for making a false promise regarding employment were dismissed for lack of merit, as evidence showed Liberty voluntarily offered services and the positions were not yet open. On the charges against Judge Lorna B. Santiago-Ubalde and other court personnel (A.M. No. P-23-086) regarding other court personnel: The complaint against Isidro Guerrero was dismissed due to his death. Aristotle Ramos was found guilty of serious dishonesty for falsifying daily time records and fined PHP 50,000.00 with a stern warning, considering mitigating factors like first offense and lapse of time. The charges against Orlando Arcilla were dismissed as he had already been warned for the same offense in a prior case. Karina Tabuzo was found guilty of serious dishonesty for falsification of daily time records and fined PHP 50,000.00 with a stern warning, similar to Aristotle Ramos, considering mitigating circumstances. The allegations of her traveling abroad without clearance were ordered to be investigated separately to afford her due process. Other charges against her were dismissed for lack of evidence. On Liberty So-Guerrero's complaint against Judge Gapas-Agbada and Judge Ubalde (A.M. OCA IPI No. 11-3764-RTJ): The complaints against both judges were dismissed for lack of merit. Liberty failed to present evidence that Judge Gapas-Agbada committed falsehood or oppression, and admitted filing the case for her husband. Similarly, there was no evidence that Judge Ubalde promised Liberty a position, and Liberty admitted volunteering services and being compensated. The Court found no basis for the claims of conduct unbecoming of a judge.
