People v. Cabilto
REITERATIONFacts
The Antecedents: On the night of April 2, 1994, around 7:15 PM, passengers including Manolito Paraiso, Fire Officer Ramon Espiritu, and Ricky dela Cruz were aboard a passenger jeepney traveling along Maysan Road, a public highway in Valenzuela, Metro Manila, en route to Malinta. Accused-appellants Alfredo Cabilto y Pacayra and Alfredo Montajes y Malinao, together with an unidentified cohort, suddenly drew .38 caliber pistols, announced a 'hold-up,' and ordered the driver to continue driving while they divested passengers of valuables: from Paraiso, a Nikon wristwatch (P550) and P900 cash; from Espiritu, a wedding ring, gold ring, wallet (P700 cash, total P2,700); from Rodolfo dela Cruz, Seiko 5 watch, ring, P100 cash; from Ricky dela Cruz, brown bag with electrical tools (P500) and P30 cash; from Leoncio Gonzales, Seiko watch (P2,200). After alighting near Fatima College, victims reported to police station; accompanied by Ricky dela Cruz and Espiritu, officers SPO1 Leandro Santos and SPO1 Angeles Miranda proceeded to Family Compound where robbers fled. Upon confrontation, Cabilto shot at Santos (missed), then during chase killed bystander Jaime Dumago y Balulong (42-year-old welder earning P250/day) who blocked his path; Montajes was apprehended separately, cohort escaped; recovered from Cabilto: .38 revolver (3 live/3 spent shells), Seiko 5 watch; from Montajes: bag with tools and ID. Victims positively identified accused at station and trial. Accused denied knowing each other; Montajes claimed at cousin's house in Karuhatan at 7:15 PM; Cabilto at LTO Karuhatan at 7:25 PM en route to cousin, apprehended and coerced. Procedural History: Charged in RTC Valenzuela Br. 27: Crim Case 4179-V-94 (PD 532 robbery with homicide), 4180-V-94 (Cabilto illegal firearms PD 1866), 4181-V-94 (attempted homicide SPO1 Santos). Arraigned April 20, 1994, not guilty pleas; trial with prosecution eyewitnesses (victims, police) vs. accused alibis. RTC July 10, 1996: Guilty robbery with homicide (Art. 294(1) RPC, reclusion perpetua, joint indemnity P50K death, P75K earnings, P50K moral, P30K exemplary to Dumago heirs); acquitted Cabilto firearms (no permit proof), both attempted homicide (absorbed); credit detention. Accused appealed claiming insufficient proof. The Petition: Accused-appellants' sole assignment: Trial court erred convicting of robbery with homicide despite failure to prove guilt beyond reasonable doubt, arguing weak identification (Santos didn't see shooter), no nexus (killing post-robbery during escape), no conspiracy proof, alibis uncontroverted, should be PD 532 not RPC.
Issue(s)
Whether accused-appellants are guilty beyond reasonable doubt of robbery with homicide under Article 294(1), RPC, including sufficiency of identification, conspiracy, nexus for homicide, and alibi rebuttal; and whether attempted homicide should be considered a separate offense. Whether convictions for illegal possession of firearms are proper, and correctness of penalty and damages.
Ruling
Decision AFFIRMED with MODIFICATIONS: Guilty of robbery with homicide, reclusion perpetua; delete moral/exemplary damages; increase loss of earning capacity to P82,639.13; order restitution of stolen items/values; acquittals in other cases affirmed; costs de officio.
Ratio Decidendi
On Issue 1 (Guilt for Robbery with Homicide): The prosecution proved guilt beyond reasonable doubt through positive, unwavering identification by three victims (Paraiso, Espiritu, dela Cruz) at police station immediately post-arrest, aided by their accompaniment in chase, corroborated by recovery of Seiko watch from Cabilto and tools from Montajes, with trial court crediting testimonies absent improper motive (People v. Obello, 284 SCRA 79; People v. Atuel, 261 SCRA 339). Nexus exists as homicide by Cabilto (per Santos' direct testimony, TSN Aug 26, 1994) during escape integrates with robbery 'by reason or on occasion' thereof, post-robbery killing still qualifies per People v. Nang (289 SCRA 16 citing Hernandez, 46 Phil. 48). Conspiracy inferred from simultaneous gun-drawing, hold-up announcement, joint divestment, and unified flight (People v. Andales, 312 SCRA 738; People v. Botona, 304 SCRA 712), imputing Cabilto's killing to Montajes absent prevention efforts (People v. Magdamit, 279 SCRA 423; People v. Degoma, 209 SCRA 266). Alibi fails: not only physical impossibility (Karuhatan proximate to Maysan/Family Compound, 7-7:25 PM), but contradicted by identifications (People v. Carullo, 289 SCRA 481; People v. Molina, 311 SCRA 517). Proper under RPC Art. 294(1) not PD 532, as no organized indiscriminate group proven (People v. Versoza, 294 SCRA 466; People v. Mendoza, 234 Phil. 273). Attempted homicide absorbed as special complex crime unchanged by additional injuries (People v. Pedroso, 115 SCRA 599). On Issue 2 (Other Charges, Penalty, Damages): Firearms acquittal correct (no permit) and barred by RA 8294 (People v. Ladjaalam, G.R. No. 136149-51); reclusion perpetua proper (Art. 63(2), RPC, no mod/aggrav); moral/exemplary damages deleted (unproven anguish, no aggravant, People v. Langres, 316 SCRA 769); loss of earning capacity recomputed via Enguito formula: [2/3(80-42)] x [P250x261=65,250 GAI - 50% expenses=32,625] = P82,639.13 (People v. Enguito, 326 SCRA 508); restitution ordered for listed items/values.
Main Doctrine
The special complex crime of robbery with homicide under Article 294(1) of the Revised Penal Code is committed when homicide occurs by reason or on occasion of robbery, requiring an intimate nexus between the two acts, which may be prior, subsequent, or contemporaneous to the robbery. Conspiracy is inferred from the mode of commission, such as simultaneous announcement of hold-up and concerted flight, rendering all participants liable for the homicide even if one did not fire the fatal shot, absent proof of efforts to prevent it. Positive identification by victims immediately post-arrest, corroborated by recovery of stolen items, prevails over denial and alibi, especially when the alibi location is in close proximity to the locus criminis. Conviction for robbery with homicide is proper despite information captioning PD 532 if elements are alleged, as highway robbery demands proof of organized indiscriminate perpetration lacking here. Attempted homicide on police pursuers is absorbed in the complex crime, and illegal possession of firearms cannot be separately prosecuted under RA 8294 when the gun is used in the robbery with homicide.
