REITERATION

Facts

The Antecedents: Appellant XXX, live-in partner of DDD, lived with DDD's daughters AAA (born Nov. 24, 1988) and BBB, whom he treated as his own children since AAA was 6 and BBB later joined. On Aug. 14, 2002 (AAA 14yo), alone in kitchen, appellant pinned AAA against wall, covered mouth, removed pants, inserted penis from behind vaginally (first time, painful), then fingered her, threatening to kill DDD if reported; stopped when DDD neared. On Aug. 21, 2002, alone (DDD/CCC out), shoved AAA face-down on sofa, inserted penis despite resistance, mouth muffled. Aug. 3, 2006 (AAA 17yo), awoke to embrace/kisses, finger insertion (nails scratched). Aug. 4, 2006 evening, alone, kissed/embraced/mashed breasts near kitchen, stopped seeing DDD. Aug. 5, 2006 8PM, molested BBB (15yo) touching thighs/breasts downstairs (she alone, family arriving); 9PM drunk, berated family as 'demonyo', chased AAA/CCC with samurai blade upstairs, burned belongings; arrested after police escort. AAA/BBB reported post-arrest. Med exam: healed hymenal lacerations 4/8/12 o'clock. Procedural History: 6 Infos (Aug. 8, 2006): CR-06-8540 (rape sexual assault AAA Aug3/06), CR-06-8541 (acts lasciviousness BBB Aug5/06), CR-06-8542 (RA9262 Sec5(c) chasing CCC/AAA), CR-06-8543 (attempted rape AAA Aug4/06), CR-06-8544/8545 (rape carnal knowledge AAA Aug14/21/02). RTC Br39 Calapan convicted all (Jun24/14): reclusion perpetua x3 rapes (qualified), indeterminate acts lasciv; 3mos arresto mayor +fine RA9262; damages varied. CA affirmed w/mod (Dec12/16): adjusted penalties/damages/interest, added psych counseling RA9262. SC appeal, adopting CA briefs. The Petition: Appellant: DDD ignored overheard proposal to 'marry' AAA; no force/weapon/violence history, AAA silent/no resistance despite routines; impossible w/CCC present/roommates; med exam stale (4yrs later)/no testimony; grudge over P80k debt; inconsistencies (BBB alone vs family home Aug5); no neighbor witnesses chasing. OSG: credible victim testimonies, no motive fabricate, minor inconsistencies immaterial; moral ascendancy; proximity negates alibi.

Issue(s)

Whether appellant is guilty of two counts qualified rape by carnal knowledge (2002 incidents). Whether acts on AAA (Aug3/4 2006) constitute lascivious conduct under RA 7610. Whether acts on BBB (Aug5 2006) constitute lascivious conduct under RA 7610. Whether violation of Sec. 5(c) RA 9262 proven. Proper penalties/damages.

Ruling

Appeal denied; CA Decision affirmed w/modification: Guilty of 2 qualified rapes (reclusion perpetua no parole, P100k each indemnity/moral/exemplary +6% int); 3 lascivious conduct RA7610 Sec5(b) (reclusion perpetua each, P75k each damages +6% int); RA9262 Sec5(c) (6mos arresto mayor max +P100k fine + psych counseling). Penalties successive.

Ratio Decidendi

On Rape by Carnal Knowledge (CR-06-8544/8545): Elements under Art. 266-A(1)(a) RPC proven: carnal knowledge through force/threat (pinned wall/sofa, superior strength, death threats to DDD). AAA's detailed, consistent testimony (crying on stand) credible— no sensible minor fabricates exposing family dishonor, risking tatay's imprisonment/death. Corroborated by healed lacerations (best evidence forcible defloration per People v. Sabal). Moral ascendancy (tatay since 6yo, live-in of mother) substitutes violence (People v. Bentayo; People v. Belen). No std reaction—silence/shock common (People v. Palanay). Victim-blaming rejected (no duty flee own home, People v. Villaros). Denial/alibi weak (Puerto Galera 40km away, possible visits). Trial/CA credibility findings binding (demeanor observed, People v. Nelmida/Regaspi). Qualified minority (<18)/relationship (common-law spouse parent), death→reclusion perpetua no parole (RA9346, AM15-08-02-SC; Art.266-B). On Lascivious Conduct AAA (CR-06-8540 Aug3: finger insert; CR-06-8543 Aug4: breast mashing): Modify from sexual assault/acts lasciviousness to Sec.5(b) RA7610 (victim 17yo <18): elements—lascivious act (IRR: finger in vagina, touching breast), child coerced by adult influence, below 18 (People v. Tulagan). Presence CCC immaterial (lust respects no place, People v. Peyra/Ofemiano). Threats/ascendancy coerce. Info alleges elements. Penalty reclusion temporal med-max→reclusion perpetua (max period, stepfather Sec.31(c) RA7610). On Lascivious Conduct BBB (CR-06-8541): Touch thighs/breasts (lascivious), 15yo coerced/threatened, prior incidents. No inconsistency—molest 8PM (BBB alone downstairs), family arrived, then 9PM rant/chase (CCC). Youth badges truth (People v. Galuga). Same RA7610 designation/penalty. On RA9262 Sec.5(c) (CR-06-8542): Attempt physical harm—drunk berating 'tatadtarin', chased w/samurai. Relationship aggravates (alt circ), max 6mos arresto mayor (Sec.6(b)), +fine P100k +counseling. Neighbors corroborative only. On Penalties/Damages: Rape: P100k each per Jugueta. Lasciv: P75k each (Tulagan). 6% int finality. No ISL <1yr.

Main Doctrine

When sexual assault under Article 266-A(2) RPC is committed against a victim aged 12 years or older but below 18, the proper designation is lascivious conduct under Section 5(b) of RA 7610, as the latter provides heightened protection for children exploited through coercion or influence of an adult. The elements include: (1) commission of lascivious conduct (e.g., finger insertion into genitalia); (2) victim is a child (below 18) subjected to such abuse due to adult coercion/influence; (3) intent to abuse/degrade. Penalty is reclusion temporal medium to reclusion perpetua, imposed in maximum period if perpetrator is stepparent per Section 31(c) RA 7610. Moral ascendancy of a father figure (live-in partner treated as tatay) substitutes for actual force/threat/intimidation in rape convictions. Healed hymenal lacerations corroborate forcible carnal knowledge; child victims' failure to resist/shout does not impair credibility, as reactions vary under stress. Denials/alibis weak against positive victim identification; proximity negates alibi impossibility.
