REITERATION

Facts

The Antecedents: Presiding Justice Romeo F. Barza of the Court of Appeals (CA) requested the Supreme Court (SC) to allow the CA to budget specific amounts for the retirement of its Presiding Justice (not to exceed P2,000,000.00) and Associate Justices (not to exceed P1,800,000.00), with a yearly increase of ten percent (10%) to cushion the effects of inflation, subject to liquidation. Procedural History: The SC, through a Resolution dated February 19, 2019, required the Fiscal Management and Budget Office (FMBO) to comment on the request. Atty. Corazon G. Ferrer-Flores, Deputy Clerk of Court and Chief of FMBO, submitted her Comment with recommendations for reduced budgets (P1,200,000.00 for Presiding Justice and P1,000,000.00 for Associate Justice), also subject to a 10% annual increase and fund availability. The Petition: The Court, after judicious consideration, deemed it appropriate to grant an increase in the retirement program budgets, setting them at P1,500,000.00 for a Presiding Justice and P1,200,000.00 for an Associate Justice. These amounts were positioned between the initial request and the FMBO's recommendation. The Court noted that the current budget of P200,000.00 for each retiring CA Justice was significantly lower than those of the Sandiganbayan and the Court of Tax Appeals (CTA), and substantially less than the SC Justices' benefits. The Court also justified the higher budget for the CA due to its larger number of employees compared to the Sandiganbayan and CTA. However, the Court denied the request for an automatic ten percent (10%) annual increase, stating that any future increase would require review and approval.

Issue(s)

Whether the retirement program budgets for the Presiding Justice and Associate Justices of the Court of Appeals should be increased. Whether an automatic ten percent (10%) annual increase should be granted to the retirement program budgets of the Court of Appeals Justices.

Ruling

The Supreme Court resolved to grant an increase in the retirement program budget for the Presiding Justice and Associate Justices of the Court of Appeals, effective July 1, 2019. The approved amounts are not to exceed ONE MILLION FIVE HUNDRED THOUSAND PESOS (PhP1,500,000.00) for a retiring Presiding Justice and ONE MILLION TWO HUNDRED THOUSAND PESOS (PhP1,200,000.00) for a retiring Associate Justice. The request for an automatic ten percent (10%) annual increase was denied.

Ratio Decidendi

On Whether the retirement program budgets for the Presiding Justice and Associate Justices of the Court of Appeals should be increased: The Court resolved to increase the retirement program budgets. It found that the current budget of P200,000.00 for each retiring CA Justice was significantly below the amounts allocated to justices of the Sandiganbayan (P450,000.00) and the CTA (P650,000.00), and substantially less than the P2,420,000.00 for the Chief Justice and P2,200,000.00 for Associate Justices of the Supreme Court. The Court also considered the larger number of employees in the CA (1,660) compared to the Sandiganbayan (421) and CTA (271), justifying a higher budget for the CA's retirement program to cover expenses such as receptions, judicial tokens, miscellaneous expenses, souvenirs, and food stubs. The approved amounts of P1,500,000.00 for a Presiding Justice and P1,200,000.00 for an Associate Justice were determined to be reasonable and midway between the initial request and the FMBO's recommendation. On Whether an automatic ten percent (10%) annual increase should be granted to the retirement program budgets of the Court of Appeals Justices: The Court denied the request for an automatic ten percent (10%) annual increase to cushion the effects of inflation. The Court stated that any subsequent increase would be subject to its review and approval, dependent on the availability of funds and prevailing circumstances. This decision ensures that budgetary adjustments are made prudently and with direct oversight from the Supreme Court, rather than being automatically applied.

Main Doctrine

The Supreme Court, in its administrative capacity, resolved to increase the retirement program budgets for retiring Presiding Justices and Associate Justices of the Court of Appeals. This increase was deemed necessary to address inflation and to align the benefits with those provided to justices of other courts of equal or higher rank, such as the Sandiganbayan and the Court of Tax Appeals. The Court approved specific amounts for these retirements, effective from a specified date, while deferring an automatic annual increase request.
