Facts

The Antecedents: Ricardo S. Nilo executed a mortgage in favor of Vicente Lopez for P9,000 on December 11, 1930, on a parcel of land. Subsequently, Nilo contracted an additional loan of P1,140 from Lopez, mortgaging two parcels of land. Romualdo F. Vijandre, a creditor of Nilo, instituted two civil actions and secured a preliminary writ of attachment registered on November 11, 1932, on all of Nilo's properties. Judgments were rendered against Nilo, and writs of execution were issued. The two parcels of land were levied upon on April 4, 1933. Vicente Lopez filed a third-party claim. Despite this, the parcels were sold at public auction on execution, with Romualdo F. Vijandre as the highest bidder. A certificate of sale was issued to Vijandre on August 3, 1933, and registered on August 9, 1933. On May 22, 1934, a deed of absolute sale was issued in favor of Vicente Lopez, discharging the mortgage credit. Procedural History: Romualdo F. Vijandre instituted an action against Vicente Lopez, wherein judgment was rendered in favor of Lopez. This judgment was reversed by the Court of Appeals. The Petition: The case reached the Supreme Court on the issue of who has a better right to the property: Romualdo F. Vijandre, the purchaser at a public auction, or Vicente Lopez, the purchaser at a private sale.

Ratio Decidendi

On the issue of priority between the attachment lien and the private sale: The Court held that the preliminary attachment on the properties, registered on November 11, 1932, had priority over the private sale executed in favor of Vicente Lopez on May 29, 1933. The purchaser in the private sale took the property subject to such attachment lien and its consequences, including the subsequent sale on execution. The auction sale, being an execution of the attachment lien, enjoys the same preference as the attachment lien itself over the private sale. Therefore, Romualdo F. Vijandre, as the purchaser at the execution sale stemming from the attachment, has a better right than Vicente Lopez, who acquired the property through a private sale subsequent to the attachment. On the issue of the execution sale being subject to prior mortgage rights: The Court acknowledged that prior to the attachment lien and the subsequent execution sale, the properties were validly mortgaged to Vicente Lopez. Consequently, the Court agreed with the Court of Appeals that the execution sale in favor of Romualdo F. Vijandre is subject to the rights of Vicente Lopez as a mortgage creditor. The rights of Vicente Lopez as a mortgage creditor, including the right to a foreclosure thereof, are expressly reserved.
