Ratio Decidendi

On Issue 1: The Supreme Court ruled that a defendant in the People's Court in Manila cannot be assisted by a person who is not a member of the bar. This is based on Sections 3 and 4 of Rule 112 of the Rules of Court. Section 3 mandates that if a defendant appears without an attorney, the court must inform him of his right to have one and assign an attorney de oficio if he desires and is unable to employ one. Section 4 explicitly states that the attorney so employed or assigned must be a "duly authorized member of the Bar." The Court further noted that exceptions to this rule, allowing non-members of the bar to assist in defenses, are only applicable in provinces where duly authorized members of the bar are not available. Since Manila has an abundance of lawyers, this exception does not apply. Additionally, Section 31 of Rule 127 states that in any court other than a justice of the peace court, a party may conduct litigation personally or by aid of an attorney, and their appearance must be personal or by a "duly authorized member of the bar." Therefore, the People's Court correctly denied Paar's petition.
